May 29, 2024
  • The Bill amends the Commitment to the Future of Medicare Act, 2004.

The amendments prohibit nurse practitioners from accepting certain payments or benefits for providing services to an insured person that would normally be provided as insured services in specified settings. Payments or benefits for these services may still be accepted from specified public sources or in accordance with the regulations.

The penalties for contraventions of the Act are increased.

A new regulation-making power permits regulations providing for and governing reimbursements of payments or benefits made for these services within six months after the day this Act receives Royal Assent.

Ontario Bill 67

43rd Parl. 1st Sess.
November 02, 2023
  • This Act, called the Temporary Nursing Agency Licensing and Regulation Act, was passed in 2023 in the province of Ontario. It establishes rules for the licensing and regulation of temporary nursing agencies. The Act defines terms such as "client," "licence," "licensee," "Minister," "nurse," "prescribed," "Registrar," and "regulations." It requires the appointment of a Registrar who has qualifications in health care profession regulation, evaluation of clinical performance, and quality improvement in a health care setting. The Act states that no person can operate as a temporary nursing agency without a licence. Licensees must publish their licence and make it available for public inspection. Nurses cannot work for an agency that has not published its licence. Clients cannot engage with an agency that has not published its licence. The Act outlines the application process for a licence or licence renewal, including requirements for nurse credentialling and monitoring plans and compliance plans. The Registrar can issue, revoke, or suspend licences based on compliance. Inspectors can be appointed to conduct inspections of licensed agencies. Complaints can be made to the Registrar. Licences are not transferable and expire after two years. The Act sets terms and conditions for licences, including establishing consistent fees, preventing unconscionable pricing, prohibiting nurses from being assigned to work for a client they are currently or recently employed by, and disclosing information to clients. The Act also includes penalties for contravention and allows for the making of regulations. It comes into force six months after receiving Royal Assent.

Ontario Bill 10

43rd Parl. 1st Sess.
August 22, 2022
  • This is a law called the Publication of Mandate Letters Act, 2022. It amends two existing laws in Ontario, Canada: the Executive Council Act and the Freedom of Information and Protection of Privacy Act. The purpose of this law is to change how mandate letters are published and treated. A mandate letter is a written communication from the Premier (the leader of the government) to another member of the Executive Council or a Parliamentary Assistant. It sets out the expectations and goals for the work that the member or assistant is supposed to do to advance the government's agenda. Under this law, the Premier is required to publish the content of each mandate letter on a government website as soon as possible, but no later than one week after the letter is issued. Additionally, any mandate letters issued on or after June 7, 2018, must be published on the government website within 60 days after this law comes into effect. The law also amends the Freedom of Information and Protection of Privacy Act to state that a head (a person in charge of a government institution) cannot refuse to disclose a mandate letter, even if its disclosure would reveal the substance of Cabinet or committee deliberations. This law will come into force on the day it receives Royal Assent, and its short title is the Publication of Mandate Letters Act, 2022.
