Mr. Speaker, it is an honour to rise, and I will be sharing my time with the member for Courtenay—Alberni. The question of how public money is spent or misspent is a fundamental question of an obligation for parliamentarians, because the Canadian people do not need to pay attention to everything that happens in Parliament. However, they need to know that there is accountability and that we respect their hard-working money being spent properly and through the right channels. I have many years of experience in the House dealing with all the smut and corruption files that have come along. I was elected in my first year as the Liberal government was telling us that Jean Chrétien's golf balls were going to keep the country together. Fortunately, the Canadian people did not believe that. That was the first scandal I witnessed. I have lost track of all the scandals. We can take misspending and put it into various categories. There are simply the tawdry ones, like with Bev Oda, who seemed to rack up as many bills as possible every time she travelled until people finally became fed up. There was the issue with Mike Duffy and Nigel Wright, where Mike Duffy was claiming all kinds of outrageous claims because he was a bagman and raised money for the Conservatives. We were presented with this bizarre case that it was okay to offer a secret bribe, but it was a problem to receive the bribe. Those scandals did not just belong to the Conservatives. There was Mac Harb, a Liberal, who had this amazing grifter scheme. He was not eligible for travel, so he bought this dodgy little broken down cottage just 100 kilometres outside of Ottawa because if he lived 100 kilometres outside of Ottawa, he could hit up the taxpayer for all kinds of travel, even though, I was told, there was not even running water at that cottage. Mac Harb had to pay back $231,000. People deserve to be outraged by that abuse, and it raised questions in the Senate of where the accountability is to make sure that the people who are there are doing their jobs. I remember Tony Clement and the $50 million that was taken out of border funds so that he could buy sunken boats and build a fake lake in Muskoka. That was an abusive process. It was not criminal; it was an abusive process. There was the issue with Arthur Porter, which was one of the more concerning scandals I have witnessed over the years. Stephen Harper appointed him as head of the Canadian Security Intelligence Service and made him a privy councillor. We then, of course, found out he was involved in what CBC said was “the biggest fraud investigation in Canadian history”, and he ended up dying in Panama in a jail. Those are elements of criminality, “griftership”, tawdriness and of people just misusing the public funds. The ArriveCAN thing needs to be put in perspective of the time, and then analyze it from there. When we were hit with the pandemic, we were dealing with a completely unknown crisis that none of us had faced, and there was certainly a need to get a response out the door quickly. Who did the best job at that? It was our public servants. They basically spent that Easter weekend in 2020 creating a program to get the CERB dollars out to people who were not able to work and to keep them going. It was the Public Service who did good, amazing work during that time. However, there were a number of scandals that came up during that period, and ArriveCAN fits into that because it is a question of the lack of oversight and accountability. Certainly, Canadians deserve to know how a contract worth $59.5 million, divided up through 32 companies, for a program that did not work was allowed to go ahead. We ask ourselves how that was possible. I would like to share with my colleagues some of the recommendations that came out of the Standing Committee on Access to Information, Privacy and Ethics, which looked into some of the other elements. We looked at Baylis Medical, at Palantir and at the Kielberger brothers. At the time, again, the government wanted to get a youth program out. There was $500 million to $940 million set aside for the Kielberger operation without competition and without very clear oversight. What the committee found was that the incredible access Marc and Craig Kielberger had into the inner workings of government gave them an advantage no one else had. I would encourage any of my colleagues to read the Ethics Commissioner report on the former finance minister, Bill Morneau. It makes for a pretty shocking reading that these guys had an all-access pass into the corridors of the Liberal government and were not even registered to lobby. That certainly was a major factor in bringing down Mr. Morneau. I want to raise this because if we have these scandals, we need to learn from them. We need to learn how money was misspent. We need to learn why there was no oversight, so that this is not repeated. Otherwise we become a laughingstock of repetition of failure from insiders, from misuse of public funds and from contracting out. With respect to the contracting out that was to be done with the WE group, I am going to read what the all-party committee said. This is not my opinion but that of all of the political parties that participated. It reported this back to Parliament: The Committee was unable to find any due diligence reports that actually tested the credibility of the claims made by the WE Charity. This group had never undertaken a project close to this magnitude and it remains unclear whether they had the means to ensure that students across the country could be put to work with credible results. It was going to be given $500 million initially, and there were no due diligence reports that we could find anywhere. Then we found out that the money was going to be funnelled to a shell company initially set up to deal with some of its incredible real estate holdings. How is it possible that the Government of Canada would transfer between $500 million and $940 million to a shell company? Who was taking the enormous risk then? It was the Canadian people. I am going to read from the all-party committee report again: The Committee is of the view that the decision of the Liberal government of Canada to sign a contract worth over $500 million with a shell company “WE Charity Foundation” is deeply troubling. The WE group stated they used the shell company to limit their liability. In reality, this procedure had the potential to put a huge investment of taxpayers funds at risk because the deal was with a shell company with no assets. How does a G7 country sign on to something that concerning? I am raising this because of the whole thing about ArriveCAN and the Auditor General's not being able to find anything on how the money was spent. One of the most disturbing factors is that after 10 months of study, we had to report to Parliament that we had no idea how the finances of the supposed children's charity worked. We could not tell the Canadian people who controlled its multitude of corporations. We did not even know all the companies that it controlled. We could not tell the difference between its so-called charity work and its for-profit work, or tell what its ownership structure was, yet the government, without doing due diligence, was going to sign over between $500 million and $940 million. The report states: The Committee notes that over the 10 months of its study, it was unable to get a clear picture of the financial structure of the WE group. We were unable to ascertain a clear division between how monies flowed through the charitable wing and their for-profit operations. We were also denied information on the ownership structure of their multitude of side companies. If the government of Canada is to sign future contracts or contribution agreements with WE Charity, its affiliates or subsidiaries, such clarifications must be required. I raise that because we are looking at a very similar thing that happened with ArriveCAN. Where was the oversight? This is the other question I am going to end on. We spent 10 months trying to get the CFO of WE to testify, just to tell us what was happening. We were told not only that he was on medical leave but also that he had a brain aneurism that, if we asked him questions, might cause his death. Certainly nobody in Parliament was going to wish that someone die under the pressure, but the WE group could not come up with anybody else who could explain its very complex financial structure. On May 15, 2021, we received a letter from Mr. Li saying that he was too sick, had not been doing any work and was completely uninvolved, yet we found that in that period, in the state of California, there was a registration renewal in November 2020 on which he signed off as CFO. There was a New York state filing on which he signed off as CFO, an Internal Revenue Service report in 2020 and a Washington State report. All of these were signed off on by Victor Li, yet our committee was told that he was so fragile and sick that he could not even read documents. We were not in a position to do a criminal investigation, but we had to report back to Parliament that there had been a major failure of fundamental accountability. Has the government learned lessons from what happened with the WE brothers, or do we have to repeat these tawdry, dumbed-down abuses of public funds because the accountability mechanisms that should have been there were ignored and the Canadian taxpayer is on the hook? I will be here all week.

Madam Speaker, the problem was that the government accepted the decision and changed the law. Now we are dealing with it. My message to government is that, from here on in, we cannot be cavalier about this. We cannot just allow unelected bodies, or even a superior court, to make a decision on something so profound. Our duty as parliamentarians is to test the law, check the law and make sure that any changes from here on in are done within a broader framework of rights, dignity and the protection of the vulnerable.

Madam Speaker, the fact that we are looking at amending the Judges Act is a positive thing, because we see, certainly in the United States, where questions about the judiciary has really raised questions about the legitimacy and trust in the overall democratic process. We have an independent judiciary in Canada, and that is very important to maintain. However, as I said, Rona Ambrose brought forward a bill to make education mandatory, because some judges just simply do not understand the dynamics that women face against the power of male sexual violence, and that is a massive disproportion. We cannot go into a courtroom and say that both sides are equal sometimes. We have to understand the larger dynamics, which was Rona Ambrose's push for change. If we look at what happened at St. Anne's residential school, and I think it will be studied in law for years to come, we need to make sure that our system is there and that the judges know the appropriate grounds so that we get better judgments in the end.

Madam Speaker, I think one thing we all agree on across all party lines is the need for justice reform. Sometimes we may disagree on where that reform should be, but we need a system that protects the rights of victims and survivors, and also makes sure those who are being accused have access to justice and justice in a fair manner. However, one of the issues that comes up again and again in Canadian society is overrepresentation of racialized communities, and particularly indigenous communities. The courts are being used to handle situations that could be handled better within community and other alternate structures, so that we are not creating a class of criminals, but actually pulling people out of some very sometimes toxic relationships or sometimes bad behaviour. The community can actually help restore and bring people back within their communities. I would like to ask my hon. colleague, from his extensive work, about the steps he thinks we need to take to start looking at the powers we can put in place to make sure those who should not be in jail can be taken out of that system and put on a better track.

Mr. Speaker, they were popping corks in the minister's office when the Supreme Court announced it would not reopen the St. Anne's residential school file, but this issue is not going away. The justice department suppressed 10,000 pages of police evidence of rape, abuse and torture of children in that awful institution, then lied in the hearings and spent millions on lawyers all the way to the Supreme Court. There is no reconciliation in Canada without justice for St. Anne's. Will the minister stand up and tell us he will meet with the survivors and establish a credible mediation process? Look at me when I am talking to you about these St. Anne's survivors. Some hon. members: Oh, oh!

Madam Speaker, I thank my colleague for her question. It is important to ensure that the system protects the rights of victims. In the case of survivors of St. Anne's and other residential schools, the problem is that the government established an alternative process, an alternative tribunal. In this system, there are no tools to give the victims and survivors recourse if the court's decision is problematic. As a result, the court must protect the rights of survivors within the tribunals for Indian residential schools, which are part of an alternative system.

Madam Speaker, I guess when I began working with the St. Anne's survivors 10 years ago, I had this naive belief that Canada's justice system would work. I believed that the justice department of Canada would follow the law. It was the decision by justice department lawyers to obtain the evidence, prepare their defence and know who all the perpetrators were but then black the names out and not turn over those documents that undermined this process. I think it is hard even for judges to believe that this could have happened, so they accepted the justice department's excuses. It is political at the first level. On the issue of reconciliation that we talk about, there is no possibility of reconciliation without justice for St. Anne's survivors. There needs to be an understanding of what went wrong in that process and what has gone wrong in other cases dealing with indigenous people before the courts so that the judges understand the need to have a broader view of their roles and responsibilities.

Madam Speaker, as always, it is a great honour to rise in this House on behalf of the people of Timmins—James Bay. Today I am particularly thinking about the Cree communities in upper James Bay, Attawapiskat, Fort Albany, Peawanuck, Kashechewan, Moosonee and Moose Factory, plus the people who have been spread across Canada, all of whom connect back to a horrific institution called St. Anne's residential school. It is important, as we talk about the act to amend the Judges Act to reflect on one of the darker decisions of the Supreme Court, its refusal to look at the miscarriage of justice that was committed against the children at St. Anne's, giving no reason or explanation. When we talk about amending the Judges Act, I think of a great parliamentarian, Rona Ambrose, who spoke up about the need for judges to get basic and legal education in dealing with sexual assault, because we have seen a number of really bad decisions, which have been referenced here. However, it is also important that our judiciary understands the findings of the Truth and Reconciliation Commission and the obligations of Canada, and that includes the courts, to address issues in terms of the equity and rights of indigenous peoples. If we look at the cases of St. Anne's residential school, it is clear that any indigenous person looking at this would wonder how it is possible to get justice in Canada. It is not a complex issue. I will talk about a really powerful woman, Evelyn Korkmaz, who suffered horrific sexual violence as a child at St. Anne's, and the collusion of the Grey Nuns, who covered it up. When she went to the hearings to tell her story, the first thing the adjudicator told her was that he was a proud member of the Knights of Columbus. They were there to adjudicate crimes against the Catholic Church and the first thing she was told by the adjudicator was that he was a member of the Knights of Columbus. Then he told her he knew the nuns of St. Anne's, that he knew that order and that they were good women. She said she knew right then that she was not going to be believed. In any other court process, that case would have been thrown out, but not in the Indian Residential Schools Settlement Agreement. One of the reasons the adjudicator did not believe Evelyn Korkmaz's story of the horrific sexual violence was that the other defendant in the case, Canada, had the legal obligation in the hearings to prepare the evidence. The adjudicator looked at the evidence supplied by the Department of Justice Canada and it said one line: that there were no known incidents of sexual abuse at Fort Albany Indian residential school. What was not told to the adjudicator was that the justice department had 10,000 pages of police testimony and witness names of rape, torture, violence and forced abortions on children in that evil institution. I think of this man who goes by the name of H-15019. He suffered horrific sexual violence. He went into the hearings to expose Father Lavoie and the justice department lawyers said he was not believable because Father Lavoie was not in the institution when the man claimed he was. As proof, they presented a two-page person-of-interest report, which was their legal obligation, on all the known potential perpetrators. A two-page person-of-interest report said Father Lavoie was not there. What the justice department was sitting on were 2,472 pages on a sick evil man who, through four decades, raped multiple generations of children. The case of H-15019 was thrown out, and when they tried to have his case reopened, the justice department and the federal government forced this case to the B.C. superior court, even though this happened in Ontario. Why would they do that? They did that because they knew that the survivors did not have the money to go to the B.C. superior court. How could anyone claim that this was a just process? What happened in that case was that, after the justice department decided to suppress the evidence, it shut the hearings down and denied justice. This is not a very complex issue. Multiple legal battles went on for 10 years and, finally, Parliament called on the government to settle with the St. Anne's survivors. The former minister sent, on March 18, 2021, a request to have the cases of St. Anne's reviewed. We thought, finally, there would be justice. That is all the survivors wanted. They wanted to review what had happened with the suppression of evidence. However, if we read the report, the request for direction sent by the federal government, it did not ask the courts to review this to get justice for children whose rape and torture had been suppressed. It did this because it said that people speaking up about St. Anne's was making the government look bad. It is right there in its request for direction. Do we know who it blamed for making the government look bad? It blamed former senator Murray Sinclair, because he said that there cannot be reconciliation without justice for St. Anne's, as well as Dr. Pamela Palmater, who raised issues about what happened at St. Anne's. Edmund Metatawabin, the survivor of the abuse, who speaks for the survivors, his name is in the government request for directions, saying that he is making the government look bad for the abuse that he suffered. Interestingly, of course, I am in there for about 30-some pages, but I do not mind that. However, Osgoode law professor Jennifer Leitch was named by the government as making them look bad because she wrote, “The government’s non-disclosure raises significant concerns about the scope of the information available to the adjudicators; the claimants’ abilities to establish abuse allegations and the scope of the compensation.” A professor of law said that this is a flawed process. The instructions given to Justice Pitfield to look at this excluded many of the horrific cases and he was directed that he was not to talk to the survivors. What kind of justice system is that? He examined 427 cases and he came back in his preliminary and he said that 81, at least, had a serious need for re-examination. That is 20% of those cases falsely adjudicated. However, in the final report, he said, no, it was just 10, student on student, with no blame to clergy, no blame to staff, no blame to government and no involvement with survivors. Of course, the survivors took this to the Supreme Court. When I talked to the survivors yesterday about the fact that the Supreme Court would not hear their case, they said that they were not surprised because this was a never a fair fight. They went with pro bono lawyers. There were days where they could not afford their own bus fare to get to the hearings, yet Canada spent millions of dollars on lawyers to shut this down. It was never a fair fight. This is why I refer to this when we are talking about Bill C-9. I am not questioning the wisdom of the Supreme Court. I am questioning the lack of understanding of the obligation, in this time, to understand the obligations under truth and reconciliation to say that we have a higher level of justice to attain here. One of the fundamental arguments of the government was that the survivors were not entitled to procedural fairness. Procedural fairness has been ruled by the Supreme Court as a fundamental right. What it meant was that the fact that they did not bother to supply any evidence and they lied in hearings, that was okay, because the survivors were not entitled to the basic principle of procedural fairness. If we look at the evidence that the government brought forward as to why procedural fairness was not a right, they put it under sealing orders so that people could not see it. What is this, Soviet-style justice? Phil Fontaine, who signed the Indian Residential Schools Settlement Agreement, wrote that they would never have signed this agreement if they were giving away fundamental legal rights under this process, which would give them fewer rights than they would get in court. Of course, Canada ridiculed Mr. Fontaine's response and said that this issue of procedural fairness was completely irrelevant. It is completely relevant. On this day, the day after the Supreme Court has shrugged and said that, whatever happened at St. Anne's, whatever happened with judges who misread the reports because they were lied to by the justice department, whatever is said about perpetrators of horrific abuse, and we have many of their names, such as Bishop Leguerrier and Arthur Lavoie, those men got away, and the survivors are still living with injustice. They deserve better in this country. They never asked for huge compensation. They asked the government to sit down and recognize that what was done to them was one of the most horrific, evil acts ever committed against innocent children. Those innocent children have had their legal rights undermined time and time again by a system that wanted to shut this process down. If we are talking about amending the Judges Act, we have to look at what happened at St. Anne's and why there was no understanding on the judge's part of the need to hold this government and the justice department of Canada to account.

Madam Speaker, as we discuss this bill, survivors of St. Anne's residential school are going to the Supreme Court over the fact that the government has spent close to $4 million fighting against their rights, and over the fact that for some of the most horrific child abuse, rape and torture cases in Canadian history, the evidence was suppressed by the justice department of Canada and officials lied in the hearings. How can the Liberal government claim that reconciliation is possible when the survivors of St. Anne's residential school have to go to the Supreme Court to get basic legal rights over the fact that their testimonies were not properly adjudicated because the government suppressed evidence to protect predator priests, nuns and brothers at that horrific institution?

Mr. Speaker, I thank my hon. colleague, and I want to go back to some of the comments she made at the beginning of her speech. We have seen some horrific judgements that women who suffered sexual assault have faced in the courts, with judges who have had some horrific opinions, not judgements but opinions, on the women. However, Rona Ambrose did come forward about the need to have judges properly trained so they actually understood these files in reference to sexual assault and abuse against women. I would ask my hon. colleague if she feels that the mechanisms within the bill would allow us to address some of the serious problems we have with judges who just do not understand the sexual assault culture facing women.
