  • Bill C-274 proposes a change to the Criminal Code regarding detainees in custody. Under the current law, an accused person who is subject to a summons, appearance notice, undertaking, or release order can be released from custody before their trial. This bill suggests that if an accused person is charged more than twice with certain serious offenses while under one of these conditions, they must be detained in custody unless the judge or justice determines that exceptional circumstances justify their release. The purpose of this amendment is to ensure that repeat offenders of serious crimes cannot easily be released before their trial.
