Bill S-13

44th Parl. 1st Sess.
February 26, 2024
  • Bill S-13 aims to amend the Interpretation Act to ensure that Acts of Parliament and regulations uphold the Aboriginal and treaty rights of Indigenous peoples recognized by section 35 of the Constitution Act, 1982. The bill also repeals similar provisions in other Acts, known as non-derogation clauses. The amendments clarify that these Acts do not abrogate or derogate from the rights of Indigenous peoples. The bill includes coordinating amendments related to other Acts that may come into force. This bill seeks to affirm and protect the rights of Indigenous peoples in Canada.

SteelmanSpren in Favour

  • sting non-derogation clauses in various Acts of Parliament have been perceived by Indigenous communities as insufficient and even harmful to their inherent rights and sovereignty. This amendment to the Interpretation Act and related Acts directly addresses Indigenous concerns by explicitly stating that all legislation and regulations must uphold the Aboriginal and treaty rights recognized and affirmed by the Constitution Act, 1982. By ensuring that Indigenous peoples are not subjected to further discrimination and that their rights are fully protected, this amendment is a vital step towards reconciliation and upholding the true meaning of the Canadian Constitution.

SteelmanSpren Against

  • One potential argument against this bill is that it could lead to conflicts with other laws and regulations that may not explicitly uphold Indigenous rights. Without clear guidance on how to navigate these conflicts, this bill could create legal uncertainty and potential difficulties in implementation. Additionally, some may argue that mandating the interpretation of all laws and regulations to always uphold Indigenous rights may not be appropriate in certain contexts and situations. Instead, a case-by-case approach may be more appropriate to ensure that the rights of Indigenous peoples are respected while also considering other important factors and considerations.

    NINETEENTH REPORT

Your committee, to which was referred Bill S-13, An Act to amend the Interpretation Act and to make related amendments to other Acts, has, in obedience to the order of reference of Wednesday, September 27, 2023, examined the said bill and now reports the same without amendment but with certain observations, which are appended to this report.

    Respectfully submitted,

    BRENT COTTER

    Chair

Observations to the Nineteenth Report of the Standing Senate Committee on Legal and Constitutional Affairs (Bill S-13)

The government of Canada’s Action Plan to implement the United Nations Declaration on the Rights of Indigenous Peoples Act (UNDRIP Act) includes a potential future amendment to the Interpretation Act to add a provision that would specifically provide for the use of the UNDRIP Act when interpreting all federal legislation. Many witnesses stressed the importance of the proposed interpretative provision in recognizing and respecting the human rights of Indigenous peoples. A few witnesses raised concerns regarding inadequate consultation on Bill S-13. Many witnesses categorically emphasized the necessity of full and complete consultation with Indigenous peoples when implementing the Action Plan, including with respect to amendments to the Interpretation Act.

This committee invites the federal government to initiate without delay the meaningful, thorough, and purposeful consultation with Indigenous peoples that is required to uphold the consultation and collaboration obligations under the UNDRIP Act in the implementation of the government’s Action Plan.
