44th Parl. 1st Sess.
May 30, 2023
  • This is a bill passed by the House of Commons in Canada called the First Nations Fiscal Management Act. It expands and modernizes the mandates of the First Nations Tax Commission and the First Nations Financial Management Board. It establishes a First Nations Infrastructure Institute that provides tools to manage infrastructure. It provides First Nations with the power to make laws to regulate services. It also simplifies the way certain Indigenous groups participate in pooled-borrowing. The bill makes consequential amendments to the Access to Information Act and to the Privacy Act.

  • ssed by-law respecting financial administration or local revenue may not repeal or amend the by-law, except with the approval of the First Nations Financial Management Board or the First Nations Tax Commission, as the case may be, and in accordance with any procedures prescribed by regulation. This ensures that the financial management and revenue-generation processes of First Nations are overseen by bodies with expertise in the area, allowing for more effective and efficient administration. It also ensures that any changes made to existing laws are done in a responsible and accountable manner.

SteelmanSpren Against

  • While the intentions behind Bill C-45 may appear positive, there are concerns about its potential negative impacts on Canadian taxpayers. By expanding and modernizing the mandates of the First Nations Tax Commission and the First Nations Financial Management Board, the bill may give Indigenous groups more power over taxation and financial management, which could result in increased taxes for non-Indigenous Canadians. Additionally, the establishment of the First Nations Infrastructure Institute could create unnecessary bureaucracy and lead to inefficiencies in infrastructure development. The bill also grants First Nations named in the schedule to the First Nations Fiscal Management Act the power to make laws to regulate services provided by or on behalf of the First Nations, which could lead to a lack of accountability and transparency. Overall, the potential costs and risks associated with Bill C-45 may outweigh its intended benefits.
