Bill C-302

44th Parl. 1st Sess.
October 27, 2022
  • Bill C-302 is a proposed law that would amend the Canada Labour Code. It aims to make it illegal for employers to use replacement workers to do the jobs of employees who are on strike or locked out. The bill outlines the conditions under which a replacement worker can be used, such as to prevent harm to people or property. The bill also includes provisions for investigating and penalties for employers who violate the law.

Mr. Speaker, we are proud to have tabled legislation to ban the use of replacement workers. Workers have been asking for this legislation longer than this country has existed. This legislation will keep unions and employers at the bargaining table, because that is where the powerful paycheques are created: at the bargaining table. Members of other parties understand the importance of this bill, and I hope members opposite will as well. Then again, this is a leader who championed two of the most anti-worker, anti-union bills the House has ever seen. Will he support the bill? We will see.

Mr. Speaker, a week ago, the Minister of Labour tabled legislation to ban replacement workers, which is a commitment we made to Canadians in 2021. Since tabling the bill, workers and unions have applauded this historic move, yet 11 days later, the Leader of the Opposition still has not taken a position on the legislation. He has had enough time to study it, so why is he hesitating to support workers? Can the Minister of Labour advise as to why the Leader of the Opposition should stand on the side of working families instead of corporate lobbyists? Some hon. members: Oh, oh!

Mr. Speaker, we are making sure that the collective bargaining process is as free and fair as it can be. We have wrapped up consultations, and we are going to take the feedback that we received from unions, employers and indigenous groups to inform legislation, to be tabled by the end of this year. This is the latest evolution in policy to protect the collective bargaining process. We need to strike a balance between doing it quickly and getting it right.

Mr. Speaker, the current Liberal government is all talk and no action when it comes to protecting the rights of workers. In the past, the Liberals have used back-to-work legislation to force workers off the picket line; now they are dragging their feet on introducing our NDP anti-scab legislation. Meanwhile, the Canadian Olympic Committee has just hired a company that has locked out its employees, and Canada Post has just produced a non-union commercial with a union-busting company. Is it trick or treat? Will the minister finally do the right thing for workers and commit to bringing in our NDP anti-scab legislation today?
