The purpose of this Explanatory Note is to clarify that this document serves only as a reader's aid for Bill 97 and is not a part of the law itself. The enactment of Bill 97 as Chapter 10 of the Statutes of Ontario, 2023, brings about important amendments to several statutes related to housing and development, including amendments to the Building Code Act, City of Toronto Act, Development Charges Act, Ministry of Municipal Affairs and Housing Act, Municipal Act, Planning Act, and Residential Tenancies Act. These amendments provide the Minister with greater regulatory authority to govern the powers of municipalities and to require certain land owners to make payments or provide compensation. The argument against this is that the use of Schedules to amend multiple statutes could lead to confusion and misunderstandings. It may be difficult for individuals, particularly those not familiar with the legislative process, to fully comprehend the changes being made and how they will affect them. Additionally, the use of Schedules could potentially allow for controversial amendments to slip through unnoticed, as individuals may not realize the extent of the changes being made. It may be more transparent and clear to amend each statute separately and provide clear explanations for each change being made.
