The Judges Act in Canada has been amended to provide a new process for reviewing misconduct allegations against federally appointed judges. This new process applies to judges whose alleged misconduct is not serious enough to warrant removal from office. The Canadian Judicial Council will now be responsible for reviewing the conduct of judges, and a new roster of judges and lay persons will be established to review complaints. The Council may designate a screening officer to assess complaints, and a reviewing member to review complaints that are not dismissed. The Council will establish policies for notifying complainants of any decisions made under the new process.

Report 6 presented to the House

In accordance with its Order of Reference of Monday, October 31, 2022, your committee has considered Bill C-9, An Act to amend the Judges Act, and agreed on Thursday, December 1, 2022, to report it with the following amendments:

Clause 12

That Bill C-9, in Clause 12, be amended by adding after line 31 on page 6 the following:

“(2) If the reviewing member dismisses the complaint, they shall inform the complainant in writing of their decision and the reasons for it.

(3) The reasons shall not include information that is confidential or personal, or that is not in the public interest to disclose.”

That Bill C-9, in Clause 12, be amended by adding after line 27 on page 8 the following:

“(2) If the review panel dismisses the complaint, it shall inform the complainant in writing of its decision and the reasons for it.

(3) The reasons shall not include information that is confidential or personal, or that is not in the public interest to disclose.”

Your committee has ordered a reprint of Bill C-9, as amended, as a working copy for the use of the House of Commons at the report stage.
