Hon. Jane Cordy: Would you take a question?

I really want to thank you so much for doing this. I was on the Social Affairs Committee, and I remember that we heard that your bill was coming before us, it was Jury Duty Appreciation Week and I thought, “Oh, well, that’s nice.” But then you were our first witness, and you spoke about your experiences, what happened afterwards and how you had no preparation going in. Then the day after the trial, you go back to your regular life — as regular as it can be after going through the trauma.

I think you spoke about the underappreciation of jurors. I have known people who have served on juries. You see them again, and it’s great that they’re finished, but they can’t talk about what they went through. It’s not even right to ask them what they have gone through.

I guess my question would be this: During Jury Duty Appreciation Week — which I think will do really good things — what types of activities do you envision taking place so that Canadians understand what jurors have gone through? We often think that a trial lasts a week or two, but we heard one witness tell us that it was months and months, and then after all this period of time, walk back into his office the next day and move along just as if life had been going on as “normal” for the previous six or nine months he was doing it.

I’m wondering if you can give us some ideas of what you envision. Hopefully, people are very creative in what they do if this bill passes. Can you tell us some of the things you think might happen that would help jurors or potential jurors understand what’s going to happen, but also to help the general public have a better appreciation of the role that members of a jury play in our society?

Senator Moncion: Thank you for the question, senator, and thank you for all the good questions that you and all your colleagues on the Social Affairs, Science and Technology Committee were asking when we, the witnesses, attended.

A lot of things are already in the process, and they were used last year in Jury Duty Appreciation Week. This information is being built as different provinces come into the program. Since we started working on the changes to the legislation for the secrecy rules, a Canadian Juries Commission has been created, and their work is to bring awareness to the work that jurors have to do.

They are working with provinces that want to come onboard. So there is information on the web that is available. There are all kinds of courses people can take or sessions they can participate in to prepare them for jury duty. There are different things that are done in different provinces.

This work has been building over the last couple of years, so more and more material is available. There is going to be more information provided for employers whenever a staff member is asked to be on jury duty. Understanding the obligations as an employer, the work that the juror is going to have to do and how time consuming that is — all this information is provided. But it will also be made more accessible.

The appreciation week just brings awareness. Then people will maybe start looking at that information and see what happens when they are called to become jurors. There is going to be more information available, and all kinds of tools are out there now to help jury duty.

Hon. Jane Cordy moved third reading of Bill S-246, An Act respecting Lebanese Heritage Month.

She said: Honourable senators, as I rise to speak at third reading of Bill S-246, I acknowledge that we are meeting on the traditional and unceded territory of the Algonquin and Anishinaabe peoples.

It is fitting that I speak today at third reading of this bill, as it is still November, and Bill S-246 would designate the month of November as Lebanese heritage month in Canada. In my second reading speech, I detailed the historical events that make the month of November significant for Lebanese people, and I will not repeat that here, but I will say that last Tuesday, November 22, 2022, Lebanese people around the world celebrated Lebanese Independence Day and 79 years of independence.

On Sunday, November 20, 2022, my city of Halifax celebrated Nova Scotia’s Lebanese Heritage Month with a ceremony and the raising of the Lebanese flag in front of City Hall. I was pleased and honoured to be invited to attend the Canadian Lebanon Society of Halifax’s event this past Saturday evening, which closed out Lebanese Heritage Month in Nova Scotia with great Lebanese food and great music. These events in Nova Scotia give Lebanese Nova Scotians the opportunity to celebrate and share their culture, their history and their contributions to their home province of Nova Scotia.

When asked during committee examination of the bill about Nova Scotia’s Lebanese Heritage Month and what he envisioned a national recognition could contribute, Wadih Fares, Honorary Consul of Lebanon in Halifax, had this to say:

When Nova Scotia declared November as Lebanese Heritage Month, it had a positive impact on our community. It showed that we are seen and we are valued and, in turn, created a stronger partnership between our community and the province. Our culture and heritage are woven into the fabric of Nova Scotia, making the province stronger and more diverse, and I believe that a national Lebanese heritage month will have the same yet even broader-reaching impact.

During the committee hearing, Senator Petitclerc referred to this bill as a tool to help bring people together, and that is exactly what this bill is intended to do. It is a tool to not only show and display Lebanese culture and heritage, but also for other Canadians to learn about Lebanese culture. For it is only when we come together that we can truly get to know one another.

As Mr. Fares said during the committee hearing:

That is the most important thing. We are a multicultural country, and I think we can be a stronger and better country if we know each other better.

Honourable senators, Canada is a country made up of countless cultures and people. Senator Housakos said it very well in his second reading speech when he said:

. . . the reality of the matter is that Canada is essentially strong because of all the sums of all our parts. It is imperative that all our parts feel that Canadian family and recognition.

Mr. Fares echoed this when he spoke of being seen and feeling valued.

This is what I hope Bill S-246 will achieve as we celebrate a national Lebanese heritage month in the years ahead. I want to thank Senator Simons and the bill’s critic Senator Housakos for their speeches and support of Bill S-246 at second reading. Also, I want to thank the members of the Social Affairs, Science and Technology Committee for their work, and their excellent questions and comments, at the committee hearing.

I would also like to thank Lena Diab, Member of Parliament for Halifax West, and a prominent member of the Lebanese community in the Halifax area, without whose support this bill would not be here today.

Lastly, I would like to recognize and pay tribute to Mr. Wadih Fares for his passion and dedication — not only to the Lebanese community, but also for a lifetime of positive contributions to his adopted province of Nova Scotia.

In 1976, Mr. Fares immigrated to Canada as a student at the onset of the Lebanese Civil War with nothing more than, as he put it, “my mother’s prayers and the will to make a good life in a new country . . . .”

Mr. Fares did just that. He gained his Bachelor of Engineering degree from Technical University of Nova Scotia, and a Diploma of Engineering from Dalhousie University. He went on to form his own successful construction company, W.M. Fares Group, which many in Halifax credit with developing the skyline of Halifax over the past 21 years. He has been recognized many times over for his business acumen. He was awarded Halifax Chamber of Commerce Business Person of the Year, Atlantic Business Magazine’s Top 50 CEO of the Year award, and named to the Atlantic Business Magazine’s Hall of Fame. He has received an Honorary Doctorate in Commerce from Saint Mary’s University in 2009 and sits on the Dalhousie Board of Governors.

He is the Honorary Consul of Lebanon for the Maritime provinces. He also sat on the Nova Scotia minister’s Immigration Advisory Council. These are just a few of his achievements. In 2012, Mr. Fares was recognized for his entrepreneurial spirit and community service, and was invested as a member of the Order of Canada.

Colleagues, Mr. Fares is a perfect example of the entrepreneurial spirit that Senator Housakos spoke of in his speech — which drives many immigrants to carve out the best life possible for themselves and for their families. These opportunities are what our country can provide, and they are the reason that many choose to make Canada their home. Immigrants to Canada can be measured in what they give back economically, socially, culturally, philanthropically and politically.

Honourable senators, immigrants make Canada a better place for all of us. Ontario and Nova Scotia were the first provinces to officially recognize November as Lebanese Heritage Month. My hope is that Bill S-246 will pass through Parliament in a timely manner, and that next year we will celebrate as a nation alongside the 400,000 Lebanese Canadians during the first national Lebanese heritage month.

My bill is a short one, but it has the potential to make a difference to a large number of Canadians — to make them feel seen, and to make them feel valued. I hope that I can count on your support.

Hon. Jane Cordy: Honourable senators, I rise on behalf of Senator Wanda Thomas Bernard to deliver her debate on Bill S-203, as she could not be with us today. She has spoken on autism spectrum disorder on a number of occasions in the Senate.

Honourable senators, I rise today in support of Bill S-203, An Act respecting a federal framework on autism spectrum disorder. This bill will call on the federal government to prioritize a national framework and develop a national autism strategy that will create long-term solutions for autistic people in Canada regardless of where they reside.

Today, I would like to share some of the impactful witness testimony heard during committee that has strengthened the bill, and I hope it will help this bill to be passed. I will also share the importance of reframing disability and autism with a strengths-based perspective and the importance of additions to the bill, such as intersectionality and inclusion.

During the committee stage of this bill, we heard essential testimony from self-advocates. Vivian Ly, the co-founder and organizing member of Autistics United Canada, reminded us that the phrase “nothing about us without us” is not just a saying; it is a call to action. This call to action is meant to be taken seriously and practised by consulting autistic people and including them in all stages of policy development. Senator Petitclerc added an observation that captures this call to action by urging the involvement of autistic people in the framework’s development stage.

Self-advocates gave compelling testimony and urged senators to consider using a strengths-based model for the bill. Vivian Ly informed the committee that the way language is used in this bill is based on a deficit model of disability. They shared that autistic people are not suffering because of autism; they are suffering because of “. . . systemic ableism and a lack of access, acceptance and supports.”

We must shift away from the deficit model towards a strength-based model that affirms and supports autistic people while addressing the systemic issues. These lessons are important for the upcoming development of this framework.

They are also an important reminder to shift our mindset for any future legislation we develop in the Senate that impacts autistic people or other people with disabilities.

Although I supported this bill in its essence to create a national framework, I believed that it needed to be more inclusive. We heard many times from witnesses that a challenge with legislation like this is that autistic people are a very diverse group, and it can be difficult to find the balance of making changes without excluding part of the group.

Inclusivity and intersectionality were important additions that ensure particular attention is paid to create equitable access to services for autistic people with unique cultural, linguistic and regional needs, while steering clear of being overly prescriptive. This addition should guide the development of a framework that considers the barriers faced by autistic people who experience intersecting oppressions such as racism, homophobia, transphobia and sexism. Some people at risk of falling through the cracks are Indigenous peoples, especially in the North, or francophone Canadians who require services in French. I believe the changes made at the committee stage account for this diversity and will ensure that more autistic people benefit from the development of the national framework.

In addition to an amendment specifically indicating the necessity of consulting with Indigenous communities, some of the other promising changes made at the committee stage are ensuring:

. . . sustained, accessible and culturally relevant resources, available online and elsewhere, on best available evidence-based information to support autistic persons, their families and caregivers, including information on effective treatments and ineffective or harmful treatments . . .

Honourable senators, when I reflect on the rigorous process my family has gone through to secure a continued support network for my grandson, I saw just how easily people can slip through the cracks without adequate support. I know from experience the constant energy it requires to monitor the services available and to adapt the plan as challenges arise. Not every autistic person experiences the same level of support my grandson has received. That is why I continue to stress the importance of ensuring this national framework is as inclusive as possible and considers all the barriers this diverse group of people experience.

I am very hopeful for the future. Between this framework and the recent announcement of Canada’s first accessibility commissioner, there are positive changes coming for people with disabilities in Canada.

Bill S-203 has the capacity to create enormous strides for autistic people in Canada, and I support the adoption of this bill with the amendments and observations made in committee.
